IMPORTANT — PLEASE READ BEFORE BOOKING
These Reservation Terms and Conditions (the “Terms”) form part of the agreement between Pebbles Beach Resort (“Pebbles”) and the person making the reservation (the “Guest”).
By submitting a reservation request, making payment, accepting a booking confirmation or checking in, the Guest confirms that the Guest has read, understood and agreed to these Terms and the applicable Cancellation Policy. The Guest accepts responsibility for ensuring that all members of the Guest’s party, including children, invitees and visitors, comply with these Terms.
1. Reservation and Guest Responsibility
A reservation is confirmed only when accepted by Pebbles and any required payment has been received.
The person making the reservation must be at least 18 years of age and is responsible for the reservation, all amounts properly owing in connection with it, and the conduct of all persons included in or visiting under the reservation.
The Guest shall provide accurate information concerning the number of persons occupying the accommodation and any other information reasonably required to administer the reservation.
2. Occupancy
Only the number of guests included and paid for under the reservation may occupy the accommodation unless Pebbles gives prior approval.
The Guest shall not assign, transfer or sublet the reservation or permit the accommodation to be occupied by persons other than authorized guests and visitors.
Parties, receptions, events and other organized gatherings require Pebbles’ prior written approval.
3. Rates, Taxes and Additional Charges
The Guest is responsible for the accommodation rate and all applicable taxes, fees and other charges disclosed in connection with the reservation.
Unless expressly included in the Guest’s reservation or package, additional charges may apply to optional amenities or services, including parking, Wi-Fi, recreational or water-sports equipment, early check-in, late checkout and other optional services.
Promotional rates, coupon codes and special offers are subject to their stated conditions, availability and expiry dates and may not be combined unless expressly permitted.
4. Payment
The Guest authorizes Pebbles and its payment processor to charge the payment method provided for amounts properly owing under the reservation.
The Guest remains responsible for authorized additional services and for reasonable charges arising from damage or extraordinary cleaning for which the Guest is responsible under these Terms.
5. Cancellation and Reservation Changes
The Pebbles Beach Resort Cancellation Policy displayed or linked during the booking process forms part of these Terms.
By completing a reservation, the Guest acknowledges having had an opportunity to review and accept the applicable Cancellation Policy.
Requests to change reservation dates, accommodation type, occupancy or other material booking details are subject to availability and approval by Pebbles and may result in a rate adjustment.
Failure to arrive does not constitute cancellation.
6. Check-In and Checkout
Guests shall comply with the check-in and checkout times specified in their reservation confirmation.
Early check-in and late checkout require prior approval and may be subject to additional charges.
The accommodation must be left in reasonably clean and orderly condition upon departure.
7. Nature of the Resort
Pebbles is a private rural cottage and beach resort situated within a significant natural environment adjacent to Crown land, conservation lands and wildlife habitat.
Guests acknowledge that insects, birds, wildlife, vegetation and other natural conditions are inherent characteristics of a rural cottage environment. Insects or wildlife may occasionally be encountered outdoors or inside an accommodation despite reasonable cleaning, maintenance and pest-management practices.
Ordinary conditions associated with the surrounding natural environment do not, by themselves, constitute a defect in the accommodation.
Guests who are particularly uncomfortable with insects, wildlife or other normal cottage-country conditions should consider whether Pebbles is suitable for their stay before making a reservation.
8. Cottage and Waterfront Location
The cottages are situated in a peaceful garden and natural setting and are not directly on the waterfront.
Pebbles’ private beach and waterfront are located on the opposite side of Long Point Road, approximately 500 feet from the cottage area.
Guests must exercise appropriate care when travelling between the cottages and waterfront and when crossing Long Point Road. Children must be appropriately supervised.
9. Private Beach and Waterfront
Pebbles provides its registered guests with access to a private beach and waterfront, subject to weather, water conditions, seasonal operations and resort rules.
THE WATERFRONT IS UNSUPERVISED. THERE ARE NO LIFEGUARDS OR WATER-RESCUE PERSONNEL ON DUTY.
Swimming and all other waterfront activities are undertaken at the Guest’s own risk.
Lake Ontario is a natural body of water. Depth, temperature, currents, waves, wind, underwater conditions and shoreline conditions can change without notice.
Children and persons requiring assistance must be continuously supervised by a responsible adult while at or near the waterfront.
10. Waterfront Hours
The waterfront and route to the waterfront are not fully illuminated for nighttime recreational use.
Guests must leave the waterfront before dark.
Night swimming and nighttime use of watercraft and water-sports equipment are prohibited.
11. Recreational Activities and Equipment
Swimming, kayaking, paddleboarding, paddle boating, snorkelling, cycling, hiking, campfires and other outdoor and recreational activities involve inherent risks.
Guests participate voluntarily and are responsible for determining whether an activity is appropriate having regard to their experience, physical ability and prevailing conditions.
Recreational equipment must be used only for its intended purpose and in accordance with applicable instructions and safety requirements.
Personal flotation devices must be used where required and are strongly recommended whenever appropriate.
No person shall operate watercraft or other recreational equipment while impaired by alcohol, cannabis, medication or any substance that may impair judgment, coordination or physical ability.
Pebbles may restrict or suspend any activity or amenity where weather, water conditions, maintenance requirements or other circumstances make its continued operation inappropriate.
12. Assumption of Risk
Guests acknowledge that staying at a rural waterfront resort and participating in outdoor activities involves risks that cannot be entirely eliminated.
Such risks may include, without limitation, uneven or slippery terrain, roads and road crossings, changing weather, trees and vegetation, insects and wildlife, campfires, docks, deep or cold water, waves, currents, swimming, watercraft and recreational activities.
To the fullest extent permitted by applicable law, the Guest voluntarily assumes the ordinary and inherent risks associated with the Guest’s use of the resort property, waterfront, recreational amenities and participation in recreational activities.
Nothing in these Terms is intended to exclude or restrict liability that cannot lawfully be excluded or restricted.
13. Children and Dependants
Parents, guardians and responsible adults are solely responsible for the supervision and safety of children and other dependants in their care.
Children must be appropriately supervised around the waterfront, roadways, campfires, recreational equipment and any other area presenting increased risk.
Pebbles does not provide childcare, lifeguard or recreational supervision services.
14. Availability of Amenities
Pebbles uses reasonable efforts to maintain its accommodations and amenities in good operating condition.
Guests acknowledge, however, that individual amenities and services may occasionally become unavailable because of weather, seasonal conditions, water conditions, maintenance, mechanical failure, utility interruption or circumstances beyond Pebbles’ reasonable control.
Pebbles will use reasonable efforts to address reported problems within a reasonable time where practicable.
Temporary unavailability of an ancillary amenity does not automatically entitle the Guest to cancellation, compensation or a refund.
15. Rural Location and Services
Pebbles is located in a rural area of Prince Edward County.
Full-service grocery stores and certain other services are more than a 20-minute drive from the resort. Guests should arrive with sufficient groceries, medications and personal necessities for their stay.
Utility, internet and telecommunications services may occasionally be affected by circumstances associated with the resort’s rural location.
16. Pet-Free Resort and Service Animals
Pebbles maintains a pet-free environment, including to accommodate guests who may have significant animal allergies. Pets are therefore not permitted.
Service animals will be accommodated in accordance with applicable Ontario law.
Where it is not readily apparent that an animal is required because of a disability, Pebbles may request documentation permitted by applicable law confirming that the animal is required for disability-related reasons.
Guests remain responsible for the care, supervision and control of their service animal and, subject to applicable law, for damage caused by the animal.
Guests travelling with a service animal are encouraged to notify Pebbles before arrival so that appropriate arrangements can be made.
17. Guest Conduct
Pebbles is intended to provide a quiet and peaceful cottage experience.
Guests shall conduct themselves responsibly and shall not engage in excessive noise, harassment, dangerous conduct, illegal activity or behaviour that materially interferes with the safety or reasonable enjoyment of other guests.
Guests shall comply with applicable laws and reasonable resort rules and safety instructions.
18. Smoking, Fire and Safety Equipment
Guests shall comply with all applicable smoking, barbecue, campfire and fire-safety requirements and any governmental fire restriction or burn ban.
Campfires and other open flames are permitted only in designated areas and when conditions permit.
Guests shall not disable, obstruct or tamper with smoke alarms, carbon monoxide detectors, fire extinguishers, security devices or other safety equipment.
19. Exterior Security Cameras
For security, property protection, occupancy management and incident investigation, exterior areas of the resort may be monitored by security cameras.
Cameras are not installed within guest accommodations or other areas in which guests would reasonably expect privacy.
Guests must not intentionally disable, damage, cover or interfere with security equipment.
Any collection, use and retention of video recordings will be subject to applicable law.
20. Damage and Extraordinary Cleaning
The Guest is responsible for damage to accommodations, furnishings, recreational equipment or other resort property caused by the Guest or persons for whom the Guest is responsible, other than ordinary wear and tear.
The Guest may also be responsible for reasonable extraordinary cleaning costs resulting from misuse of the accommodation or a material breach of these Terms.
Guests shall promptly report material damage or breakage to Pebbles.
21. Personal Property
Guests are responsible for safeguarding their vehicles, valuables and personal belongings.
To the fullest extent permitted by applicable law, Pebbles is not responsible for loss, theft or damage to personal property except where liability cannot lawfully be excluded.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Pebbles Beach Resort and its owners, officers, employees, contractors and agents shall not be liable for loss, damage, injury or expense arising from the ordinary and inherent risks voluntarily assumed by a Guest in connection with the Guest’s use of the property, waterfront, recreational amenities or equipment.
Nothing in these Terms excludes, restricts or modifies any liability, right or remedy that cannot lawfully be excluded, restricted or modified.
23. Indemnification
To the fullest extent permitted by applicable law, the Guest shall indemnify and hold harmless Pebbles Beach Resort and its owners, officers, employees, contractors and agents against reasonable claims, liabilities, losses, damages and costs arising from:
- a material breach of these Terms by the Guest;
- damage caused by the Guest or a person for whom the Guest is responsible;
- unlawful or intentional misconduct by the Guest or such person; or
- a third-party claim arising from the acts or omissions of the Guest or persons for whom the Guest is legally responsible,
except to the extent arising from conduct or liability of Pebbles that cannot lawfully be excluded or transferred.
24. Entry to Accommodation
Pebbles respects the privacy of its guests.
Pebbles or its authorized representatives may enter an accommodation where reasonably necessary for maintenance, repairs, safety, emergency response, investigation of a material breach of these Terms or another legitimate operational purpose.
Except in an emergency or where immediate entry is reasonably necessary to protect persons or property, Pebbles will make reasonable efforts to provide advance notice.
25. Circumstances Beyond Pebbles’ Reasonable Control
Pebbles shall not be responsible for delay, interruption or inability to provide an accommodation, amenity or service resulting from circumstances beyond its reasonable control, including severe weather, flooding, wildfire, road closure, utility failure, governmental action or comparable events.
Where the reserved accommodation itself becomes unavailable and Pebbles cannot reasonably provide suitable alternative accommodation, Pebbles may cancel the affected reservation and refund amounts paid for the unavailable accommodation.
Nothing in this section affects rights or remedies that cannot lawfully be excluded.
26. Termination of Stay
Pebbles may, acting reasonably and subject to applicable law, require a Guest or visitor to leave the property where that person:
- materially breaches these Terms;
- exceeds authorized occupancy;
- engages in illegal, threatening, dangerous or seriously disruptive conduct;
- intentionally or materially damages resort property; or
- materially interferes with the safety or reasonable enjoyment of other guests.
Where a stay is terminated because of the Guest’s material breach, any entitlement to a refund shall be determined in accordance with the reservation terms and applicable law.
27. Drinking Water
Guests must bring their own potable drinking water for drinking, cooking, food preparation, making ice and other consumptive purposes.
The water supplied to the cottages is provided for non-consumptive domestic purposes. Guests must not rely upon or use cottage tap water as potable water unless Pebbles expressly advises otherwise in writing.
Guests are responsible for bringing a sufficient supply of commercially bottled or other potable water for all members of their party for the duration of their stay.
This requirement applies to all persons included in or visiting under the Guest’s reservation. The Guest is responsible for ensuring that all members of the Guest’s party, including children, dependants, invitees and visitors, are made aware of and comply with this requirement.
28. No Waiver
A failure or delay by Pebbles in enforcing any provision of these Terms does not constitute a waiver of that provision or Pebbles’ right to enforce it subsequently.
29. Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or severed only to the extent necessary and the remaining provisions shall continue in full force and effect.
30. Governing Law
These Terms and the Guest’s reservation are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Subject to any statutory right that cannot lawfully be restricted, the parties attorn to the jurisdiction of the courts and tribunals having jurisdiction in Ontario.
31. Entire Agreement
These Terms, together with the Guest’s reservation confirmation, applicable rate conditions, Cancellation Policy and any additional terms expressly agreed to in writing, constitute the agreement governing the Guest’s reservation.
If there is an inconsistency between these Terms and a specific term expressly stated in the Guest’s reservation confirmation, the specific reservation term shall govern to the extent of the inconsistency.
32. Electronic Acceptance
The Guest agrees that electronic acceptance of these Terms has the same effect as a handwritten signature to the extent permitted by applicable law.
BY SUBMITTING A RESERVATION REQUEST, MAKING PAYMENT OR SELECTING “I AGREE TO THE TERMS OF SERVICE,” THE GUEST CONFIRMS THAT THE GUEST HAS HAD AN OPPORTUNITY TO READ THESE TERMS AND THE CANCELLATION POLICY BEFORE BOOKING AND AGREES TO BE BOUND BY THEM.
